Article 1 Definitions

In these terms and conditions, the following definitions apply:

Additional agreement
An agreement whereby the consumer acquires products, digital content and or services in connection with a distance agreement and such goods, digital content and or services are supplied by the entrepreneur or by a third party on the basis of an arrangement between that third party and the entrepreneur.

Withdrawal period
The period within which the consumer may exercise the right of withdrawal.

Consumer
The natural person who does not act for purposes relating to his trade, business, craft or profession.

Day
Calendar day.

Digital content
Data produced and supplied in digital form.

Continuous agreement
An agreement providing for the regular delivery of goods, services and or digital content over a certain period.

Durable data carrier
Any tool including email that enables the consumer or the entrepreneur to store information addressed personally to them in a way that allows future consultation or use for a period appropriate to the purpose for which the information is intended and that allows unchanged reproduction of the stored information.

Right of withdrawal
The possibility for the consumer to withdraw from the distance agreement within the withdrawal period.

Entrepreneur
The natural or legal person who offers products, access to digital content and or services to consumers at a distance.

Distance agreement
An agreement concluded between the entrepreneur and the consumer within the framework of an organised system for distance selling of products, digital content and or services whereby up to and including the conclusion of the agreement exclusive or joint use is made of one or more techniques for distance communication.

Model withdrawal form
The European model withdrawal form included in Annex I of these terms and conditions. Annex I does not have to be made available if the consumer has no right of withdrawal for their order.

Means of distance communication
A means that can be used to conclude an agreement without the consumer and entrepreneur being in the same place at the same time.

If the activity of the entrepreneur is subject to a relevant licensing system
The details of the supervisory authority.

If the entrepreneur practices a regulated profession
The professional association or organisation to which they are affiliated
The professional title and the place in the EU or the European Economic Area where it was granted
A reference to the professional rules applicable in the Netherlands and instructions on where and how these rules can be accessed


Article 3 Applicability

These general terms and conditions apply to every offer made by the entrepreneur and to every distance agreement concluded between the entrepreneur and the consumer.

Before the distance agreement is concluded the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible the entrepreneur will indicate before the agreement is concluded how the terms can be consulted and that they will be sent free of charge upon request.

If the distance agreement is concluded electronically the text of these general terms and conditions may be made available electronically in such a way that the consumer can easily store them on a durable data carrier. If this is not reasonably possible it will be indicated where the terms can be consulted electronically and that they will be sent free of charge upon request.

If specific product or service conditions also apply in addition to these general terms and conditions the consumer may always rely on the provision that is most favourable to them in the event of conflicting conditions.


Article 4 The Offer

If an offer has a limited period of validity or is subject to conditions this will be explicitly stated in the offer.

The offer contains a complete and accurate description of the products digital content and or services offered. The description is sufficiently detailed to allow the consumer to properly assess the offer. Images used are a true representation. Obvious mistakes or errors do not bind the entrepreneur.

Each offer contains information that makes it clear to the consumer what rights and obligations are attached to acceptance of the offer.


Article 5 The Agreement

The agreement is concluded at the moment the consumer accepts the offer and fulfils the conditions set out therein.

If the agreement is concluded electronically the entrepreneur will immediately confirm receipt of acceptance electronically. Until confirmation the consumer may dissolve the agreement.

The entrepreneur will take appropriate technical and organisational measures to secure electronic data transfer and ensure a safe web environment.

The entrepreneur may verify whether the consumer can meet payment obligations. If the entrepreneur has good grounds not to enter into the agreement they may refuse the order or impose special conditions.

Upon delivery the consumer will receive information including the visiting address for complaints the right of withdrawal warranty information pricing payment and delivery methods termination conditions and the model withdrawal form if applicable.

For continuous agreements this applies only to the first delivery.


Article 6 Right of Withdrawal

For products
The consumer may withdraw from the agreement within at least 14 days without giving any reason.

The withdrawal period starts the day after the consumer or a designated third party receives the product.

For services and digital content not supplied on a tangible medium
The withdrawal period starts the day after the agreement is concluded.

If the entrepreneur has failed to provide legally required withdrawal information the withdrawal period is extended by twelve months.


Article 7 Consumer Obligations During the Withdrawal Period

The consumer shall handle the product and packaging with care and may only inspect the product as permitted in a physical store.

The consumer is liable for diminished value resulting from handling beyond what is permitted.

The consumer is not liable if required withdrawal information was not provided.


Article 8 Exercising the Right of Withdrawal and Related Costs

The consumer must notify the entrepreneur within the withdrawal period.

The product must be returned within 30 days.

The consumer bears return costs unless stated otherwise.

If withdrawal occurs after requesting early service performance the consumer must pay proportionally.

All additional agreements are dissolved automatically upon withdrawal.


Article 9 Obligations of the Entrepreneur in Case of Withdrawal

The entrepreneur confirms receipt of withdrawal.

All payments are refunded within 14 days using the same payment method.

Additional delivery costs are not refunded if a more expensive option was chosen.


Article 10 Exclusion of the Right of Withdrawal

The right of withdrawal may be excluded for custom made products hygiene sensitive items worn rugby shoes personalised items digital content with consent and other legally excluded products.

Used mouthguards worn shoes or personalised products cannot be returned.

If the stud key is missing, €20 will be deducted.
If studs are missing, €20 will be deducted.
If a box (original packaging) is damaged or missing, €20 will be deducted.

No refund will be processed until the original shoe box has been returned. The same applies to scrum caps and other items supplied in original packaging.

These costs will be deducted from the total refund amount.


Article 11 The Price

Prices remain unchanged during the stated validity period except for VAT changes.

Prices include VAT unless stated otherwise.


Article 12 Performance of the Agreement and Additional Guarantee

Products and services must comply with the agreement and legal requirements.

Additional guarantees do not limit statutory consumer rights.


Article 13 Delivery and Execution

Orders are executed within 30 days unless agreed otherwise.

Risk passes to the consumer upon delivery.


Article 14 Continuous Transactions Duration Termination and Renewal

Continuous agreements may be terminated with a notice period of no more than one month.

Automatic renewal is subject to legal limitations.

Trial subscriptions end automatically.


Article 15 Payment

Payments must be made within 14 days unless otherwise agreed.

Late payment may result in statutory interest and collection costs.


Article 16 Complaints Procedure

Complaints must be submitted promptly and are answered within 14 days.


Article 17 Disputes

Dutch law applies exclusively to these agreements.


Article 18 Additional or Deviating Provisions

Additional provisions may not disadvantage the consumer and must be recorded in writing or on a durable data carrier.
